This agreement (“Agreement”) is entered into by and between Fitsa (“Company”) and the user (“User”) accessing or using the Fitsa food delivery platform (“Platform”). By accessing or using the Platform, User agrees to be bound by the terms and conditions set forth herein.

1. Ordering Process:

Users can place orders for Items through the Fitsa website or mobile application.
Users are responsible for providing accurate delivery information, including address and contact details.
Once an order is confirmed, it cannot be canceled or modified.
2. Payment:

Users agree to pay for all orders placed through Fitsa, including the cost of Items, applicable taxes, delivery fees, and any optional tips.
Payment is processed securely through the Fitsa platform using the payment method provided by the User.
3. Delivery:

Fitsa aims to deliver orders within the estimated delivery time provided at the time of order confirmation.
Delivery times may vary based on factors such as traffic, weather conditions, and order volume.
Users acknowledge that occasional delays may occur and agree not to hold Fitsa liable for such delays.
4. Refunds and Returns:

Refunds or credits for orders may be issued in accordance with Fitsa’s refund policy.
Users must report any issues with orders, such as missing or incorrect Items, to Fitsa’s customer support within a reasonable timeframe.
5. User Responsibilities:

Users agree to use Fitsa in compliance with all applicable laws and regulations.
Users are responsible for maintaining the confidentiality of their Fitsa account credentials and for all activities that occur under their account.
6. Intellectual Property:

All content and materials on the Fitsa platform, including logos, trademarks, and software, are the property of Fitsa and its licensors.
Users may not reproduce, distribute, or modify any content on the Fitsa platform without prior written consent from Fitsa.
7. Privacy:

Fitsa collects and processes User’s personal information in accordance with its Privacy Policy.
By using Fitsa, Users consent to the collection, use, and disclosure of their personal information as described in the Privacy Policy.
8. Termination:

Fitsa reserves the right to terminate or suspend User’s access to the platform at any time, for any reason, without prior notice.
Upon termination, User’s right to use Fitsa ceases immediately.
9. Limitation of Liability:

Fitsa shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with User’s use of the platform.
Fitsa’s total liability to User for any claims arising under this Agreement shall not exceed the total amount paid by User to Fitsa for the applicable order.
10. Governing Law:

This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions.
Any dispute arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts of [Jurisdiction].
